• Introduction These Terms and Conditions (the “Agreement”) govern the relationship between Arrive Realty & Finance (“we,” “us,” “our”) and our clients (“you,” “your”) with respect to our real estate and mortgage brokerage services.
• Scope of Services We provide real estate and mortgage brokerage services to assist clients in buying, selling, or financing residential or commercial real estate. Our services include listing properties for sale, providing property search services, processing loan applications, communicating with clients regarding real estate and loan options and terms, and providing support throughout the transaction process.
• Fees We charge fees for our real estate and mortgage brokerage services. These fees will be disclosed to you prior to engaging our services. Fees may be based on a percentage of the sale or loan amount, a flat fee, or a combination thereof. Fees are due upon completion of the transaction process and are non-refundable.
• Representation and Warranties You represent and warrant that all information you provide to us in connection with our real estate and mortgage brokerage services is true, accurate, and complete. You acknowledge that we will rely on this information in providing our services.
• Third-Party Service Providers We may engage third-party service providers, including lenders, appraisers, title companies, and other service providers, to assist in providing our real estate and mortgage brokerage services. We will use reasonable efforts to ensure that these service providers meet our standards for quality and professionalism.
• Limitation of Liability We will not be liable to you for any damages arising out of or related to our real estate and mortgage brokerage services, except for our gross negligence or willful misconduct. In no event will we be liable for any indirect, consequential, or punitive damages.
• Termination Either party may terminate this Agreement at any time upon written notice to the other party. Upon termination, any fees paid to us will not be refunded.
• Governing Law and Jurisdiction This Agreement will be governed by and construed in accordance with the laws of the State of California. Any disputes arising out of or related to this Agreement will be resolved in the state or federal courts located in the State of California.
• Amendments We may amend this Agreement from time to time by providing you with notice of such amendments. Your continued use of our real estate and mortgage brokerage services after such notice constitutes acceptance of the amended Agreement.
• Entire Agreement This Agreement constitutes the entire agreement between you and us with respect to our real estate and mortgage brokerage services and supersedes all prior or contemporaneous communications and proposals, whether oral or written.
